Terms & Conditions for Pre-Purchase Inspections
Definitions
We/our/us - Davies & Gray Vehicle Inspections, The Retreat, 39 Gillbent Road, Cheadle Hulme, Cheadle, Cheshire SK8 7LE. Telephone 0161 485 5773.
Assessor - The Vehicle Engineer Assessor/Inspector assigned by us.
You - Our customer.
Inspection - The vehicle inspection provided by us.
Report - The written report produced by the assessor.
Business Hours - Monday to Friday 8.30am - 5.30pm, Saturday 9am - 12.30pm.
Fees and Cancellations
- The Inspection fee must be paid for in full before the Inspection takes place.
- If a booking is cancelled the cancellation fee of £30 plus VAT will be charged unless otherwise stated (See note three & four below)
- If the booking is cancelled before the close of business on the day before the inspection, the cancellation fee of £30 plus VAT will be charged.
- If the booking is cancelled on the day of the inspection, the late cancellation fee of £50 plus VAT will be charged.
- If the Assessor turns up only to find the vehicle is not available for inspection on the appointed day at the address agreed it will be treated as cancelled and the late cancellation fee will apply.
- Any times and dates that we set for the inspection and report are subject to change.
Your Responsibilities
- You must ensure that all permissions have been obtained from the owner of the vehicle and the vendor for us to inspect the vehicle. Failure to do so may mean that the inspection is cancelled and the cancellation fee will apply.
- If a road test is to be carried out, the vehicle must roadworthy, have a current MOT and road fund licence (or trade plates must be supplied), and be driveable.
- You must ensure all keys are available for the vehicle along with the vehicle's registration documents, service history etc.
- There must be sufficient fuel in the vehicle ready for the road test.
- The vehicle must be on a hard level surface away from the public highway otherwise the inspection may be restricted.
- The availability and use of a hoist or inspection pit would be an advantage and any additional cost for its use will be your responsibility.
- You, the buyer, must satisfy yourself that any modifications to the standard car are acceptable by way of statements and documentation from the seller.
Our Responsibilities
- The report is strictly confidential and is for the information of the person instructing us who is selling or buying the vehicle. The report cannot be used, relied upon or transferred to a third party without our written consent. We accept no liability to any third party. You agree that you will make no representation to the contrary and that you will advise third parties accordingly.
- A Vehicle Data Check (VDC) is included as part of all of our pre-purchase inspections. We endeavour to do this prior to attending the vehicle but sometimes the VDC can only be done on-site. If the VDC shows the vehicle to have an undesirable history, we will contact you to discuss whether the physical inspection should proceed. Cancellation fees will apply as mentioned above (under Fees and Cancellations). We cannot be held responsible for the accuracy of the VDC since it is obtained, in good faith, from an independent third party and the VDC may not, in itself, be conclusive.
- The make, model and specification of all vehicles is as per badges displayed, documents provided and or from the VDC. We cannot be held responsible for the validity of any such marks.
- We take great care with our inspections however we do not accept responsibility for defects latent or otherwise.
- The inspection is based on external visual examinations only and on such items as are mentioned. No dismantling will be undertaken and defects discoverable only by internal inspection would therefore not be revealed.
- A limited road test will be carried out, but not at high speed.
- We cannot test for fuel or oil consumption. The identification of the source of any leaks is not included but will be commented on where evident.
- Electrical components are tested by switching on and off. Electronics and management systems are not interrogated, diagnosed or tested other than by general observations.
- The accuracy of any instruments or gauges cannot be tested or confirmed.
- The life expectancy of any component of the car including exhaust systems, battery etc cannot be assessed.
- Brakes can still be effective even if linings, discs or drums are worn.
- Four wheel drive and performance systems can only be checked at normal road speeds and road conditions.
- Air bags and some other safety devices, if fitted, cannot be tested as they are a use once item.
- We will endeavour to give the client a brief verbal report on the day of the inspection and follow that up by sending a written report within 48 hours by the agreed method. The written report will prevail.
No Guarantee or Warranty
The Davies & Gray Vehicle Inspection Service is designed to empower the customer with such information that they can make an informed purchasing decision. Davies & Gray Vehicle Inspections do not guarantee nor attach any warranty to the Service provided.
In the unlikely event that any defects of consequence are discovered after purchase, which were not mentioned in the report, please contact our helpline on 0161 485 5773. If we consider it appropriate we will arrange for a re-inspection of the affected area to give an unbiased second opinion.
Queries and Complaints
Any query regarding the Inspection should be directed to Davies & Gray Vehicle Inspections. Any query regarding the Report should, in the first place, be directed to the Assessor who inspected the vehicle and then to Davies & Gray Vehicle Inspections. Any complaints should be in writing and sent to Davies & Gray Vehicle Inspections, The Retreat, 39 Gillbent Road, Cheadle Hulme, Cheadle, Cheshire SK8 7LE.
Force Majeure
We are not responsible for any loss, damages, costs, claims or expenses which you may incur as a result of our delay in or failure to perform our obligations where such delay or failure is due to causes beyond our control. Causes beyond our control include: fire, flood, earthquake, accident, civil disturbances, war, rationing or embargoes, strikes, labour problems, delays in transportation, inability to secure necessary materials, delay or failure of performance of any supplier or subcontractor, acts of God and acts of Government.
Governing Law
This agreement is governed by the laws of England and any disagreement or claim will be settled by the courts of England, Scotland or Northern Ireland according to your normal place of residence. These terms do not affect your statutory rights.
